Council's reply
You raised concerns in regard to the proposal to rezone and reclassify lots 10 & 11 DP 236342 being part of Albert Ryan Park, Batemans Bay. In response, I offer the following advice on these matters.
Council’s 2010 Recreation and Open Space Strategy recommended that the public toilets on lot 10 be investigated for disposal as they will be surplus to requirements as “Future development of Batemans Bay Marina will render amenities at this location obsolete.” p.26 (ROSS). Further, Councils Public Toilet Service Review 2014, finalised in 2015 also calculated this facility to be surplus to requirements.
On 12 April 2016 Council resolved in part to proceed with initial community consultation prior to the preparation of a formal planning proposal to rezone and reclassify the land. Consultation on Albert Ryan Park is due to close on 3 June 2016 having been extended from 13 May 2016.
The purpose of this consultation is to gauge community attitude to the idea of disposing of the subject land. Community feedback will help Council to decide whether or not to proceed with a formal planning proposal.
I am aware from the submissions received to date, that a number of concerns have been raised with regard to coastal hazards and other matters. All of the issues raised will be given due consideration prior to any decision being made.
Following the exhibition period, Council will be briefed on the submissions received. The matter will then be reported to the Council for consideration and determination.
I can advise you that the submissions received to this initial consultation have been overwhelmingly opposed to proceeding any further. At this time I am unable to advise what the recommendation to Council will be as the submission period is still open, however I can advise that the recommendation will be influenced by the submissions received.
